PodFriendly AI is a subscription-based software-as-a-service that uses artificial intelligence to generate Print-On-Demand ("POD") designs and related assets. Features, models and limits may evolve over time.

You must provide accurate information when registering and are responsible for safeguarding your credentials and for all activity under your account. You must be at least 16 years old to use the Service.

Paid plans are billed in advance on a recurring monthly or yearly basis through Stripe. Subscriptions renew automatically until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period. Pricing may change with notice.

You agree NOT to:

• resell, share or sublicense your account credentials;
• use automated scripts, bots, scrapers or unauthorized API access;
• circumvent rate limits, fair-use thresholds or technical protections;
• generate content that is illegal, hateful, sexual involving minors, defamatory, harassing or infringes third-party rights;
• attempt to extract model weights or reverse engineer the Service;
• use the Service in any way that disrupts or harms it or its users.

Abuse, fraud or violation of these Terms may result in immediate suspension or termination without refund.

AI output is generated probabilistically and may be inaccurate, unoriginal or unsuitable for a given use case. You are responsible for reviewing generated designs before publishing or selling them. We do not guarantee that any output is free of similarity to existing works or eligible for trademark, copyright or POD-platform approval.

Subject to your compliance with these Terms and an active subscription, we grant you a worldwide, non-exclusive license to use, modify and commercially exploit designs you generate on the Service ("Commercial Use Included"), including selling them on platforms such as Etsy, Shopify, Amazon Merch, Redbubble and similar POD marketplaces.

The Service itself, including software, branding, UI, prompts engineering, model integrations and documentation, is owned by PodFriendly and protected by intellectual property laws.

You are solely responsible for the legal, regulatory and platform compliance of any product you sell using generated designs — including trademark clearance, copyright, content policies of POD marketplaces and consumer protection laws in your jurisdiction.

We may add, change, suspend or discontinue features at any time, including modifying models, limits, pricing or UI, to keep the Service modern, performant and economically viable.

We may suspend or terminate your account at any time for violation of these Terms, suspected fraud or abuse, non-payment, or where required by law. You may stop using the Service at any time by cancelling your subscription.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR UNINTERRUPTED AVAILABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PODFRIENDLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These Terms are governed by the laws of the jurisdiction in which PodFriendly is established, without regard to conflict-of-law rules.

We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the updated Terms.
